The following terms are applicable for any products that you purchased with us.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Return and Refund Policy:

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Ariel Fortunio LLC DBA Chthonic, 254 Chapman Rd, Ste 208 #5935, Newark, Delaware 19702, USA

  • Goods refer to the items offered for sale on the Service.

  • Orders mean a request by You to purchase Goods from Us.

  • Service refers to the Website.

  • Website refers to Chthonic Company.com, accessible from www.chthoniccompany.com

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

 

International Shipping notice:

Customs fees and tax, Duties, VAT tax, Shipping Carrier Brokerage Fees, and Shipping Carrier Storage Fees

Buyers (You) are responsible for the customs fees, duties, and tax (VAT) charge in their country. There will be no refund, replacement, or store credit, if Your package is sent back without tax, duty, or any other fee charges paid in Your country or paid online (i.e the UPS / DHl website) or if the package is destroyed or held by customs.  

Buyers (You) are responsible for any shipping carrier brokerage fees or storage fees charged by the carrier company (i.e UPS Brokerage Fees).

 

ORDERS BEING SHIPPED TO SOUTH KOREA: PERSONAL CUSTOMS CODE

Buyers (You) located in (or with an Order shipping address in) South Korea are responsible for entering their Personal Customs Code at checkout, when placing their Order. If for any reason You forgot to enter this code, or  You believe it is incorrect, please contact Us. Orders without this code may be delayed, returned to Us by customs, or destroyed by Customs. There will be no refund, replacement, or store credit, if Your package is returned to Us by customs, or destroyed by Customs.

Shipping times and estimated processing times:

Most shipment and / or processing times (fulfillment times) for Goods are listed under each product (Goods) under the  "shipping" dropdown menu, please note these are estimated times, and these refer to the time it takes to process and fulfill your Order, these times are periodically updated to account for order volume, estimated order volume, packaging time, etc. The shipping service You choose at checkout determines the total number of days it takes to receive your Order. After Your Order has been fulfilled and shipped you may track it in the "Shop" app,  by signing in to Your account, typing Your provided tracking number into the shipping carrier website (i.e www.USPS.com), or you may wait for Our the periodic email updates. 

Pre-order items:

We are excited to offer pre-order options for some of our most popular Goods. Please note that pre-ordered Goods typically arrive within a 1-2 month window, depending on the specifics outlined in the product (Goods) description and / or "shipping" drop down menu of the product page.

We kindly request that You refrain from reaching out to Us for status updates before the 1-month mark. Rest assured, we are dedicated to completing and fulfilling Your Order as quickly as possible, and We will provide you with Order conformation(s) and Status updates when available or upon request.


Your Order Cancellation Rights

You may cancel Your Order (without incurring any fees), for a full refund, without giving any reason for doing so, within two hours of placing Your Order. In order to exercise this right, You must inform Us of Your decision within two hours of placing Your Order by means of a clear statement. You can inform Us of Your decision by:

 

After the two hour period prior to Your purchase, You may still exercise Your right to cancel Your Order. However, the following fees and exclusions may apply.

An Order with a grand total of less than $150 USD, can be canceled for a refund less a $10 USD fee for restocking. If Your Order grand total exceeds $150 USD, the Order can be canceled for a refund less a $25 USD  fee for restocking - many of Our pieces and materials are limited in quantity, and require labor intensive assembly and / or detail work.

Cancellations cannot be made after production on an Order or  Goods within the Order has already started. Nor can an Order be canceled after the Order has shipped, or any Goods within the Order have shipped (i.e Order is fulfilled in multiple shipments). Orders for any Backordered/Pre-Order Goods including, but not limited to Goods with the term “Frost” or “Made to Order” in the  Goods product description or title, cannot be canceled as that Order is sent directly at the same time to Our manufacturer(s) / artisan(s)  to be produced. 

 

In order to exercise Your right of cancellation after the two hour period prior to Your purchase, and assuming Your Order meets the above criteria/conditions for cancellation. You must inform Us of your decision by means of a clear statement. You can inform us of your decision by:

 

 

We will reimburse (refund) You no later than 15 days from the day on which We receive the returned Goods or confirm Your canceled order. We will use the same means of payment as You used for the Order.
